Whedon property transfer, 1843

A handwritten document detailing the sale of property in Hebron, NY by James Whedon (1771-1846) to his son James J. Whedon (1822-) and his wife Mary M. Forbes (1836-). The senior James was 72 years old at the time and his wife Rebecca Tyrell (1787-1857) was 56. The document explains that he is "...by reason of his age and infirmities is not so capable of attending to his estate and affairs..." As such he transfers his estate to his son and son's wife at no cost but in exchange for "...Maintenance or support in meat, drink, washing, lodging, apparel and attendance both in sickness and in health..."

The document does not specifically identify the property's location. It's got to be in Hebron but even that isn't specified, only that the people lived there somewhere.

James Whedon (1771-1846) was Martha Whedon (1809-1869)'s father, Daniel Clement (1796-1872)'s father-in-law, and Rachel Clements (1787-1843)'s grandfather.

This Indenture, made the 29th day of May 1843 Between James Whedon of Hebron in the County of Washington and State of New York of the one part, and James J. Whedon, Mary Whedon of the other part--

Whereas the said James Whedon being the Father of the said James J. Whedon and Mary Whedon by reason of his age and infirmities is not so capable of attending to his estate and affairs as formerly, and has therefore agreed for the advancement of the said James J. and Mary to make over his property to the said James J. Whedon and Mary Whedon so that the said James J. Whedon should afford him the said James Whedon and his wife Rebecca a Maintenance as is herinafter mentioned: Now this indenture Witnesseth (?) that the said James Whedon in order to carry the said agreement into effect, and in consideration of the natural love and affection which he hath for his said children, and all of the provisions, covenants and agreements, hereinafter mentioned by the said James J. and Mary, to be observed and performed, hath given, granted, and bargained unreadable and assigned and by these presents, doth give, grant, bargain, sell, and assign unto the said James J. and Mary, their heirs and assigns all and singular, my debts, credits, rights, and personal estate whereof I am now unreadable (except my household furniture so called). To have and to hold the same unto the said James J. and Mary their heirs and assigns forever without rendering any amount or being therefor [sic] in any unreadable accountable to the said James Whedon his heirs, executors, administrators or assigns for the same or any part thereof.

And further it is provided that the said James J. Whedon for the above and other considerations heretofore granted, shall find and provide for the said James Whedon and his wife Rebecca sufficient Maintenance or support in meat, drink, washing, lodging, apparel and attendance both in sickness and in health suitable to their condition, state, and situation, whenever they or either of them may see fit to call for the same or cannot do without the above provisions in the manner aforeseaid.
